1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Khushi ("we," "us," or "our") regarding your access to and use of the Khushi mobile application and related services (collectively, the "Service").

By creating an account, accessing, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

2. Eligibility and User Requirements

2.1 Age Requirements

You must be at least 13 years of age to use the Khushi app. If you are under 18, you must have parental or guardian consent to use the Service. Users under 13 are strictly prohibited from using the app.

2.2 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update such information to maintain its accuracy. Providing false information may result in immediate termination of your account.

2.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach.

3. Description of Service

Khushi is an emergency safety companion mobile application designed to provide quick access to emergency services and assistance. The Service includes, but is not limited to:

• Emergency assistance request functionality
• Location-based services for emergency response
• Emergency contact notifications
• Safety resources and information
• Communication with emergency services

Important Notice: While Khushi facilitates connection to emergency services, we do not directly provide medical, security, or emergency response services. We are a technology platform that connects you with appropriate emergency resources.

4. User Responsibilities and Acceptable Use

4.1 Appropriate Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Submit false emergency requests or misuse emergency services
• Use the Service to harass, threaten, or harm others
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or extract source code from the app
• Use the Service for any commercial purpose without authorization
• Violate any applicable local, state, national, or international law
• Transmit any malicious code, viruses, or harmful content

4.2 Emergency Use

Khushi is designed for genuine emergency situations. Misuse of emergency features, including submitting false alerts, may result in account suspension, legal action, and notification to law enforcement authorities.

4.3 Device Requirements

You are responsible for maintaining compatible devices, internet connectivity, and necessary permissions (such as location services) required for the Service to function properly.

5. Intellectual Property Rights

5.1 Ownership

The Khushi app, including all content, features, functionality, software, designs, graphics, text, logos, and trademarks, is owned by Khushi and is protected by international copyright, trademark, and other intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. This license does not include any right to:

• Modify, copy, or create derivative works
• Sell, rent, lease, or sublicense the app
• Remove or alter any proprietary notices
• Use the Service for competitive purposes

5.3 User Content

You retain ownership of any content you submit through the Service. However, by submitting content, you grant us a worldwide, royalty-free license to use, store, and process such content as necessary to provide the Service.

6. Limitation of Liability

6.1 Service Limitations

While we strive to provide reliable service, we cannot guarantee uninterrupted or error-free operation. Factors beyond our control, including network connectivity, device limitations, and third-party service availability, may affect the Service.

6.2 Emergency Services

Khushi facilitates connection to emergency services but does not replace traditional emergency communication methods (such as calling emergency numbers directly). In life-threatening situations, always call your local emergency services number immediately.

6.3 Third-Party Services

We are not responsible for the actions, services, or availability of third-party emergency responders, medical professionals, or other service providers accessed through the app.

6.4 Maximum Liability

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

7. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability or fitness for a particular purpose
• Warranties regarding accuracy, reliability, or timeliness of information
• Warranties that the Service will be uninterrupted or error-free
• Warranties that defects will be corrected

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

8. Indemnification

You agree to indemnify, defend, and hold harmless Khushi, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your submission of false or misleading information

9. Termination and Suspension

9.1 Termination by User

You may terminate your account at any time by contacting us at info.khushiapp@gmail.com. Upon termination, your right to use the Service will immediately cease.

9.2 Termination by Khushi

We reserve the right to suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms or our policies
• You misuse emergency services or submit false alerts
• Your account poses a security or legal risk
• We are required to do so by law
• We discontinue or materially modify the Service

9.3 Effect of Termination

Upon termination, all provisions that by their nature should survive will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the app, email, or by posting an updated version with a new "Last Updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

We encourage you to review these Terms periodically to stay informed of any changes.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, specifically the laws applicable in the state of Goa, without regard to conflict of law principles.

11.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts in Panaji, Goa, India.

11.3 Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

12. Miscellaneous Provisions

12.1 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

12.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Khushi regarding the Service and supersede all prior agreements and understandings.

12.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

12.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

12.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, acts of war, terrorism, or government restrictions.
